Why Yes, That is a Carnival Operator Pulling a Toddler to Safety When the Ride Broke Down

This is hilarious, and great footage for a personal injury attorney should the rescue operation go wrong (which, fortunately, it didn’t). The ride broke, and the operators had to climb to the top of the ride to rescue the children.
This is a conversation about this issue:
What is a reasonable time frame of calling your attorney to check the status of your personal injury case? I know you can call anytime you want to but, is once a week or every 2 weeks obsessive? The case is to the point of the defense attorney excepting mediation/offer a settlement or going to trial. As it seems there is no other person to do a deposition on.
Thanks for any serious advise.

You can call all you want and still get the same answer. We are waiting to see if this will be mediated, settlement offered or going to trial. Calling will not change the answer or speed things up.
My guess is that they have made an offer that either your lawyer or you do not agree with, thus the possibility of mediation. There could be a dispute on liability, coverage or the injuries you sustained in this accident that is in dispute.
If there is mediation, then they have to set up a date to do this. This will be set up with your lawyer, the insurance company lawyer and a 3rd lawyer that “mediates” between the other 2 and hopefully will get everyone to agree to a settlement when the mediation is done. The outcome could be what you want or not, depending on the evidence to date.
Your lawyer may choose instead of mediation to go to trial instead, or by state law has to do mediation 1st before going to trial. Going to trial may have the same results, worst or better, since in any trial there is no guarantee of the outcome. If he decides to go to trial, then you could be waiting 2 years or more before “your day in court”, since the courts are “clogged” with everyone wanting their day in court.
You have hired a lawyer, so he has a “vested” interest in this settlement, since YOU will be paying him a percentage of the money out of your settlement per the contract you signed with him.
My suggestion is to make an appointment in person to discuss with the lawyer, since he will have his file in front of him to discuss your options. Everyone wants to call, but most likely will get the brush off and just state we are still waiting. With an in person appointment, he can state this will take 1 month, 1 year etc and his “objective” of what he believes will happen.
